I have been instructed by the Seanad Committee on Statutory Rules, Orders and Regulations to refer to the Creamery Butter (Prices for Catering Establishments) (No. 2) Order, 1948, S.I. No. 355 of 1948, and to request you to be good enough to indicate the specific enactment or portion of an enactment, with the relevant lines thereof, which it is claimed confers power on the Minister for Agriculture to make the provisions in paragraphs (1) and (2) of Article 3 of the Order that of the fixed price of 3s. 5d. per lb. an amount calculated at the rate of 9d. per lb. shall be paid on account to the Minister for Agriculture and that the amounts so paid shall be paid by him into the Dairy Produce (Price Stabilisation) Fund.

With reference to your letter of the 4th instant relative to the above-named Order, I am to state that the power of the Minister for Agriculture to make this Order is derived from Article 31 of the Emergency Powers Order, 1939, as amended by the Emergency Powers (No. 173) Order, 1942. Both of these Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946.


The provisions at (1) and (2) of Article 3 of the Order, which prescribe the manner in which the purchase price is apportioned, are considered consequential on the fixing of this price.
