PAYMENTS FROM PRISONS VOTE IN RESPECT OF CRIMINAL LUNATICS CONFINED IN DISTRICT MENTAL HOSPITALS

The classes of prisoners who may be transferred to mental hospitals and the statutory provisions authorising their transfer are as follows:—

In the case of prisoners found insane while on remand, while awaiting trial or while serving sentences the statutes provide that the prisoners must be sent to the mental hospital for the district in which the prison is situated. Prisoners found unfit to plead may be sent to the mental hospital for the district in which the prison is situated or to the Central Criminal Asylum at Dundrum. Persons found guilty but insane may be detained in any place directed by the Minister for Justice. It will be seen from the foregoing that the Minister for Justice cannot choose the district mental hospital to which an insane prisoner is to be sent execpt in the case of a person found “guilty but insane.” When persons who are found guilty but insane are not sent to the Central Criminal Asylum, they are usually sent to the mental hospital for the district to which they belong, so that they will be in a convenient place to receive visits from relatives and friends.


The following statement shows the number of “criminal lunatics” who were detained in each district mental hospital during the year 1944-45, and the annual rate at which the State paid for their maintenance.
