APPENDIX IV.INTERPRETATION OF “AGRICULTURAL LABOURER” IN HOUSING ACTS. I submitted to the Minister for determination under the Labourers (Ireland) Act, 1919, the case referred to in question 24 and subsequent questions of the Minutes of Evidence before the Committee of Public Accounts on the 24th April last. He is of opinion that in the case referred to the keeping of lodgers was not a trade or handicraft. The payment of the grant of £30 for the reconstruction of the house was made in good faith. At the time the Department was aware of a Court decision that the keeping of lodgers was a trade. On further consideration it appears that the facts of the decided case were not similar to the case in question. The Minister’s decision will be acted on in future so that there will be no further instance of the kind liable to challenge. (Signed) J. HURSON, Accounting Officer, 18th July, 1941. Department of Local Government and Public Health. |
