APPENDIX IV.

MINES ROYAL IN IRELAND.

Memorandum by the Commissioner of Woods


with regard to


Royalties and other matters.


1. The Royalty on Gold and Silver is:—


1/25th in land where the Crown owns all the minerals.


1/50th in land where private owners have all the minerals, except gold and silver;


and a dead or certain rent (merging in the Royalty) will be reserved.


2. “Take Notes” for a year, as well as Leases for a term of years, will in accordance with the recent practice, contain clauses for working, which must be complied with.


3. In granting Take Notes and selecting from among several applicants regard will be had to the following conditions:—


(a) The grouping of the areas in reference to their relative position and the water supply with a view to their economic working under a Lease, if proved to be sufficiently rich in gold.


(b) Where, on any sett, considerable work has been done, and substantial machinery has been erected for crushing and extracting the precious metals, applications by the owners of such works and machinery for adjoining lands within reasonable limits to enable them to work the gold on a sufficient scale will receive the first consideration.


(c) Where the Commissioner of Woods can arrange with the owner of mineral rights in private lands to accept as his sub-Lessee of the Mines Royal the person selected by the Crown, the owner may become the Crown Lessee and sub-let to the Crown nominee on terms to be approved by the Commissioner of Woods.


In no case will a Lease be given without working covenants, but every Lease will give the Lessee the option of relieving himself of the covenants by surrender of the Lease on reasonable conditions.


(d) When application is made for a Take Note or Lease of Mines Royal in private lands, the applicant will be required, if need be, to give an undertaking to pay the expenses to be incurred by the Department in obtaining the reports by experts which may be deemed necessary.
