(Second Report of the Committee on Procedure.)

In submitting herewith to the Dáil for consideration a further Report of their Proceedings, the Committee on Procedure authorise me to make the following observations thereon.


The recommendations of the Committee are contained in the accompanying Schedule, which is divided into two parts. The first contains some new Orders of which the Committee recommend the acceptance. Some fresh subjects are introduced. Thus, rules are submitted governing proceedings prior to the election of the Ceann Comhairle in a new Dáil. A further group of Orders regulate the method of dealing with the Motion to Proceed to the Next Business. Two important financial rules are introduced: one imposing restrictions on the debate of supplementary Estimates; the other enabling the general policy of a Minister in respect of a Department to be discussed without involving a particular Item. Other Orders deal with the matter of constituting the House, and with the issuing of writs, and the receiving of reports from the Clerk. The second part of the Schedule contains some further amendments to the existing Orders.


On the 22nd March, 1923, a Message from the Seanad was received by the Dáil requesting approval of the Dáil to a Joint Committee on Standing Orders, with a view to the adoption of agreed Standing Orders regulating inter-communication between the two Houses. In consequence of this it was resolved by the Dáil:—


“That the Message from Seanad Eireann be referred to the Committee on Procedure to take such action thereon as they consider advisable.”


In pursuance of this instruction the Committee met the Standing Orders Committee of the Seanad on the 18th April. The representatives of the Seanad brought forward proposals bearing on the following subjects:—


(1) Summoning of Joint Sittings;


(2) Initiation of Joint Committees;


(3) Facilities for members of either House to visit the other House, and to speak and answer questions on Bills in which they are interested;


(4) Manner of certifying Money Bills; and


(5) Method of dealing with Private Bills.


Your Committee, having taken these proposals into consideration, decided to recommend to the Dáil a change in a Standing Order adopted by the Dáil on the 8th March, Whereby Joint Sittings will be summoned by the Ceann Comhairle after consultation with the Cathaoirleach of the Seanad. Agreement was not reached on some of the matters discussed. It was agreed that further meetings would be held on outstanding points.


Your Committee think that the present position of the Standing Orders, in so far as they deal with Public Business, justify their publication in book form. They suggest that the Constitution should be included, for many of the Orders are intelligible only by reference to it. They recommend accordingly that the Dáil authorise that the Standing Orders be edited and indexed and brought out in the form indicated.


In addition to the Joint Meeting referred to above, the Committee met on five occasions since submitting their last Report.
